We do this all the time in the prospect draft, like when Ducks selected Hampton Slukynsky. But the main issue that came up was that there wasn't any clarity of whether Hart or the other suspended players were available or when or how they would be available and at least 2 other teams said they probably would've picked Hart before 3.4.
